New Jersey Gambling Laws

New Jersey authorized online gambling by passing A2578 in February 2013. The bill amended the state’s 1976 Casino Control Act to legalize online casinos, creating a licensing process and establishing regulations to govern the industry.

A2578 establishes a tax of 15% on online gaming revenue and requires operators to invest 2.5% of online gaming revenue into the Casino Reinvestment Development Authority (CRDA). The CRDA supports economic and community development in Atlantic City through various redevelopment projects throughout the city.

New Jersey casinos must pay a $400,000 online gaming license fee plus a $250,000 responsible gaming fee. Additionally, the state requires a $250,000 renewal fee and a $250,000 responsible gaming fee each year.

The New Jersey online gambling law would have expired in 2023 due to a ten-year sunset provision, “unless reauthorized by law.” However, the legislature extended legal online gambling in New Jersey for an additional five years via Assembly Bill 2190 in June 2023. The bill initially called for a ten-year extension, but some lawmakers pushed for a two-year extension. Ultimately, the legislature settled on a five-year extension.

New Jersey Online Gambling Regulations

The New Jersey Division of Gaming Enforcement is in charge of processing online gambling license applications, issuing regulations, and overseeing the conduct of licensees.

Under NJ law, each Atlantic City casino may launch up to five independently branded gambling sites, or “skins” – usually in partnership with outside operators. Numerous international gambling brands have thus managed to enter the NJ market by reaching agreements with AC casinos to operate off their online gaming licenses.
